Harvey, LA asked in Family Law and Child Support for Louisiana

Q: If I'm a single mom with a 7 year old working a part time 15-25 hours a week is it state law to dock me for 37?

I'm a single mother on Medicaid and foodstamps, I have a part time job that is scheduled around my daughter school schedule which I'm roughly working 15-25 hours a week. I roughly bring home 500 to 600 a month and the ADA has me bring my last 6 check stubs and the hours went from 13 one week too 25 being the highest and the ADA told me that wasn't enough that she was gonna put me down for 37 hours a week now they have me making almost 1400 a month which is completely absurd. They are gonna be taking 300 out of the 5 or 600 a month I bring in including paying 10 a month for his medical with cort costs and arrears. Are they allowed to completely falsify someone's income not to mention falsified court documents? saying I'm making 37 hours a week at roughly 1400 a month. Something just felt fishy like she was favoring the dad as if they know each other.

A: The nondomiciliary parent is imputed with full time income from the date child support is sought. Until a child turns age five, the domiciliary parent is not imputed with income. When the child turns age five, the domiciliary parent is imputed with full time income. Subsequent children are not a consideration for either parent.
