Q: What is the exact TN code I need to cite in a letter requesting coverage limits from an at-fault driver’s insurance co.?
I have composed a letter to a policyholder’s insurance company by whom I was rear ended on December 18, 2020. I typed:
“I was involved in an automobile collision with your insured on December 18, 2020. The purpose of this correspondence is to request and demand, pursuant to [relevant TN Code] the following information
1. Any and all known policies of insurance insuring the above-referenced policyholder. Said insurance shall include any excess umbrella insurance.
2. The exact name of the insurer.
3. The name of each insured.
4. The limits of coverage.
You may provide a copy of the declaration page of any policy insuring the above insured in lieu of providing the above-described information. The information requested herein, pursuant to the above-stated Code section, should be provided within (x) days.”
I would like to cite the exact Tennessee code to increase the likelihood of their cooperation. I have also prepared an affidavit page to send certified mail.
A: You do not have a right to find out about some tortfeasor's insurance. If it appears that no liability insurance was provided at the accident scene, then report the driver and vehicle to the DOS Financial Responsibility Section. This should put the driver's TNDL in jeopardy. You may wish to hire an attorney to represent you.
