Q: Do I need to file for a temporary custody order if I am trying to leave my husband but both children want to live w/ me?

We have been married for 11 years. He owns the house but we have lived in it together since he bought it. Our two children (12 and 7) want to live with me. He has had 8 different jobs in the past 10 years and whenever I tell him I want to leave, he seems to lose his job within the month. He is currently unemployed and I am not sure he is looking for a job at all. I have no idea what the first steps are, however, he has told me to get an attorney because he wants joint custody...which my children do not want!
