Q: Does the Dimler rule apply for 54 in a 45, or not because it was not a 55 or a 65 speed limit zone?

My son received a 54 in a 45 speeding ticket. The office said it would not impact insurance since it was only 9 over. In reading the statutes, this seems fuzzy when it’s in this speed limit zone.

A: The Dimler law only applies to 55 and 60 mph speed limit zones, for drivers other than those in a commercial vehicles or those who hold a CDL. The Minnesota Department of Public Safety, as a result, would place a 54 in 45 speed limit zone on the driver's license record, if the court certifies the conviction after either paying the ticket, pleading guilty or losing a trial. But, since the police officer apparently misunderstood the law, perhaps the prosecuting attorney will agree to off er a disposition that would prevent it from going on the driver's license record. But to do that, he'll need to ask the court to set it for a first court appearance.
