Q: Planned to divorce my wife ,she filed a false domestic violence complaint. What are the chances of dismissal of charges
She married me just for the sake of getting US Green card.when i came to know her real intentions and she was constantly pressuring me for filing her green card ,decided to divorce her .
Even i went to police ,told them that she is threatening me ,if I don’t file her green card ,she would not spare me .they didn’t write my report at that time .After 2- 3 days when i told her that i don’t want to continue this marriage.Next day when i left for my job like every other day .The moment i left she called police and filed a false domestic complaint against me ,which I didn’t even know because police never came to me.Even my divorce got finalled ,she disappeared didn’t show in the court. After divorce,I applied new job ,they did my background check and then i came to know that about 8-9 months ago ,she filed a false domestic complaint against me which never happened.I immediately turned myself in .Now what are the chances of this case ?
Will my domestic violence charges get dismissed.?
A: You have not stated whether it is a criminal charge or an order of protection. Either way do not have anything to do with the woman, including saying anything about her. Hire a competent attorney to investigate the case and minimize the problems. Hopefully there will never be any proof of violence, and whatever it is gets dismissed and expunged. You apparently are not able to handle this yourself.
