Q: I lost my parental rights to my 3 children in 2018 and want to get them back. I also have an old warrant to take care of
My youngest is in foster care and his father is deceased. I want to fight to get him out. I can prove that I have everything I need to take care of him and have been sober for over 2 years. My two oldest are doing great with their dad and I’m able to speak to them but I’m beyond upset about my youngest. Is it possible to get him out of foster care? I desperately need help. Can some one please point me in the right direction? I also need help with an old warrant from 2017 so that’s off of my shoulders before I go into fighting cps. Is there a lawyer out there willing to do both of these cases? Or do I need a separate one for each case? Please help me sort this out. I desperately need answers.
A: You will likely need two different lawyers because your issues are with two completely separate areas of the law. Your warrant is the easier of the two to deal with, and you can start by contacting a criminal attorney in the area where your warrant is from. Your parental rights issue is far more complex, and at this point, you'll need an attorney versed in child protective proceedings and appeals. I don't like to say "never" but the reality is that termination of parental rights is an extreme measure a court must take in some situations and is intended to be permanent. Once the period to appeal by right expires, or you are not successful on direct appeal, you have, to put it mildly, an uphill battle against a vertical wall.
