Plant City, FL asked in Family Law for Florida

Q: Can the father deny step father doing activities with kids ex hunting and fishing. If so what can I do I'm the step dad.

Step son want to go hunting wife has primary custody we were going to sign him up for a hunter safety camp in the summer and possibly take him hunting next year. He excitedly told his dad about whom lives out of state and spends little to know time with them he threw a big fit and said we aren't allowed to do that and he's calling his lawyer the son is 10 and wants to do it and we are paying for it can we just send him what's the worst that can happen we get a motion to not send him. Also this seems to be an issue anytime I try to do anything big one on one with either of the children are we going to have to go to court everytime we want to go camping as a family or go on vacation cause we didn't get his approval first. Wife has full custody with him having minor visitation he gets them a week at Christmas every other spring break and 5 weeks in the summer other than that never sees them even though he's allowed more time.

A: Relax; it appears that the boy's father is spouting hot air. If your wife has physical custody she can do whatever she reasonably wants.

A: The terms that you are using are unclear and any attorney would need to review the actual court order to provide specific information. If there is a Marital Settlement Agreement or Court Ordered parenting plan, it should set forth day to day decisions, summer care/camp decisions, and parental responsibility as either sole or shared (or shared with ultimate decision making). At the end of the day, it is up to the Mother and Father to follow the orders that are currently in place in regard to the decision making aspects.
