Q: I was divorced about six years ago but the marital home remains in my name what can In do?
Ex remarried and he and his present wife live in this home.
A: That depends on what your divorce decree says. If the final order doesn't require the house out of your name, you are stuck.
A: I'm thinking that you didn't have an attorney for the divorce. This type thing should never happen. If the divorce settlement doesn't address this situation and the house was always in your name, the law as your situation sits right now would seem to be in your favor that you own the house. Hopefully, you aren't the one paying the mortgage. If you are you're in a mess. The likely thing that needs to be done here is that you are going to have to suck it up and discuss this with your ex. The best thing you can do for yourself is meet with a divorce attorney before you speak with the him. If I'm right and you didn't have counsel for the divorce, you certainly don't want to make the same mistake twice. If you d-i-d have counsel for the divorce, then get on the phone and call your attorney. Somebody missed the ball.
A: What did your order say regarding the home when you got divorced? You need to go back to that and verify the info and then go from there to take action.
