Q: Will I go to jail for misdemeanor criminal trespass if it’s my first time in Terrebonne parish, Louisiana?

A friend and I took our truck down a farm road and I got stuck in a 20x20 piece of cane field. We got a summons to court for misdemeanor criminal trespass and it’s a first for the both of us. We don’t have criminal records and we’re worried when we go to court we’re going to be sent to jail for it. What are the chances we will just get a fine? Or are we going to have to go to jail?

A: If everything you say is accurate, then you are not going to jail. That said, you could be charged with a misdemeanor and have it end up on your criminal record, plus pay various amounts of money for fines, fees and classes. You and your friend really should hire an attorney(s) to advise and represent you on these charges so it will minimize the impact on your criminal record and pocketbook. Good luck.
