For example, did the non-profit road association place liens on the property after the bank’s mortgage was already in place on the property? If so, then it sounds like the non-profit road association is a party in interest with respect to the foreclosure action and would want to file a response to the complaint, perhaps with an accompanying affidavit, substantiating the details of its liens and the amounts owed, with a per diem going forward.
