Marinette, WI asked in Criminal Law for Michigan

Q: I need some major advice ASAP! This will only let me write up to 120 characters, and my question is very long.

I was walking down the Street a guy pulled up to me assume that I was a girl that ripped him off because he's a drug addict, long story short he grabbed my phone out of my hand and smashed it on the ground and then got his car and left. ( the whole time all this occurred my daughter was on my phone I had just gotten out of orientation and was asking her to come pick me up because I was walking home, she heard the whole thing) I went down the road to the gas station called the cops let them know what just happened and that very cop turned it around on me and the prosecutor put out two felony warrants for my arrest and said that I lied about the whole situation.( No I do not have insurance on my cell phone nothing like that) he lied to the cops and told them none of that happened that I was a liar and the cops believed him I got arrested went to jail and now I have two felonies against me what do I do? I do have an attorney however he will not return my phone calls nothing,

A: I'm not sure what your question is. You have the right to make the prosecutor prove their story through a trial. And if you are awaiting a preliminary examination, you have a right to make the prosecutor show probable cause for these charges, which your attorney can then challenge.

Yours is not the first case where one person says one thing, and another person says another. And because you don't state what charges you face, it's impossible to tell if even that is a factor in the charging decision.
