The short answer is that, presence alone (inside of a house that is raided) is not enough for an arrest. Officers are required to have reason to believe that the defendant had access to and the ability to exercise control over the drugs that were found. As such, the circumstances surrounding the arrest become very important in these type cases. So while they are not suppose to arrest you for simply being present, they will generally look for other ways to connect you to whatever was found.
