Q: In a law suit a claim against a persons home insurance is giving a deposition considered going to trial?
They way im understanding that is not considered going to trial it pre trial? Wondering why i can not get a answer? This is supposedly a free ask a question get a answer site is it or is it not ?
A:
A deposition is an interview of a witness under oath, taken in cases for various reasons, primarily for the deposition-taker (the party who is asking the questions) to prepare for trial, and in many cases, to use in support of a summary judgment motion, which requests the court to toss out the claim(s). Your inquiry reflects that you are completely in the dark about standard court procedures applicable to your situation. Are you in small claims court? My guess is that you're not, since depositions are unusual there. If not a small claim, you will be in deep trouble if you do not hire an attorney or at least schedule a consultation with one to get official, reliable advice about procedures and strategy. Even if a small claim, it would be helpful for you to consult an attorney, as there is much you need to know about how you should conduct yourself in a deposition.
