Jupiter, FL asked in Car Accidents for Florida

Q: I was rear ended and driver left the scene. I have been treated for back spasms. Do I have a case?

I do have a preliminary accident report on file. The sheriffs department has to investigate to locate the driver and vehicle in order to complete report

A: Yes you have an injury claim. Did you have uninsured motorist coverage on your vehicle? If you did, you can make a claim with your insurance company if the other driver is not located or the other driver is located and does not have insurance. If the other driver does have insurance, you make a claim thru that insurance company. Feel free to reach out to me as we can verify if there is insurance of the other driver. Also check your declarations page to see if you have uninsured coverage. Also you make a claim through PIP for your medical bills as long as you did not delay to seek treatment.

A: Yes, you have a case. Retain counsel here in Florida on contingency fee, which means you don't pay anything unless you win. Keep in mind you have 14 days from the date of the accident to seek medical attention in order to preserve your PIP benefits.
