Lake Orion, MI asked in Criminal Law for Michigan

Q: How can a PPO NEGATIVELY affect someone on probation?

y question is if I set up a PPO against someone that has harassing me and physically assaulted someone in my house that is on probation. How would it affect the person that is on probation? Especially if the probation is to stay away from police contact. The reason why I’m asking is the aggressor charged At the person who resides in the house, who is on probation, with premeditated motives and actually attacked the person on probation. He just defended himself in front of where they resides. Would me getting a PPO On the attacker have a negative effect on the person who is on probation?

A: This is a tough question to answer because the correct answer depends on a lot of variables that we cannot anticipate - in the case of assault, who is the aggressor and the attacker sometimes comes down to credibility and is rarely clear cut. Generally, just because someone is on probation doesn't mean they are left vulnerable to assaults. But that person is the victim and would be the one to call the police, not you. If you are also being harassed by the attacker, you can petition for your own PPO, which would have no bearing on the person on probation.
