A: Unless you have signed a prenuptial or postnuptial agreement, a spouse in a divorce or in a probate has substantial rights. No matter what your husband does in a Will or other estate planning, as long as you do not sign and agree then you will have rights to your Homestead Property as well as various assets if your are not properly, correctly and fairly cared for in the estate plan and will or trust documents. So, to answer your question, no matter what your husband writes down, unless you agree he cannot leave you out and you would have claims and rights upon his passing.
