Q: In Louisiana can you have a property settlement agreement signed prior to filing for divorce if your living separate?

A: No, it will not stand up. You can have a Post-Nuptial Agreement if you are still married or a Partition Consent Judgment if your divorce is final.

A: It is possible to terminate your community while still married, however, that is not exactly what you are asking. Also, you can get your community terminated rather quickly after filing for divorce. But you post says (community) property settlement signed prior to filing for divorce-----anyway, this is important stuff you are doing and you want to do it right (so it does not come back up in the future), so I recommend that you immediately contacting a few community property/divorce attorneys, sit down with them, discuss your situation specifically, and decide how to proceed, including possibly hiring one to represent you.
