Q: If my divorce was final almost 3 years ago. How is my ex allowed to file for partition of community property

A: Until the community is partitioned, you and your ex are joint owners indivision of the community property. I recommend that you contact a community property/family lawyer in your area and sit down and discuss the specifics of your situation. Good luck.

A: Either party can file to partition the community any time after a Petition for Divorce is filed. You will both remain co-owners of the community property until that time.

A: There is no time limit on when your spouse can file to partition the community property. You need a lawyer.
