A: A business or individual whose permanent home is outside the United States can apply for and own a trademark registered here.

The applicant must appoint and be represented before the United States Patent and Trademark Office (USPTO) by an attorney who is licensed to practice law in any US state.

Contact a US trademark lawyer. He or she will search for possible conflicting trademarks that have already been filed and could prevent or delay your registration. The attorney will then prepare your trademark application and handle correspondence with the USPTO.

A: Application for federal registration of a trademark by a non-US citizen can be done through a qualified US attorney, if the mark is being used for goods or services sold in the US. Contact me for a free consultation.
