Q: Can I file for an annulment on my own if the marriage was never consummated & he was aware of his ED without telling me?

I’d like to avoid high legal costs (GA) and my husband is aware of my desire to file. Can an annulment only be filed by an attorney? and do we have to be separated for 6 months with an annulment? We’ve been separated in the same household for 9 (separate sleeping quarters). No children. No assets. No joint debt.

A: The process for an annulment versus a divorce is not that different, so in general I would not advise filing for an annulment on the basis of impotence because that is unnecessarily embarrassing for no reason.

An uncontested divorce takes 35 days. If you file for annulment, and he contests it, you would put yourself in the position of having to prove that he is impotent, which quite frankly is not very easy to do.
