Q: Neighbor's tree (large)fell onto my fence. Tree was cut and rolled over fence. Who is responsible?
The tree layed on the fence and above the fence (tree was paralel above the fence) however when the neighbor cut the tree (base of tree and roots in his yard and roots a foot from the tree were in my yard) the tree roled over the fence line or layed on my side of the fence.
A: If the tree was on your neighbor's property and he cut it, and if it did damage to your fence or other property, he may be liable for the damage to your property. He may also be liable for the cost of removing it.
