Q: BATTERY FAMILY VIOLENCE, LEGITIMITATION, GUARDIANSHIP
THANK YOU FOR YOUR TIME. I'M GOING THROUGH A CASE FOR BATTERY FAMILY VIOLENCE THAT MY KIDS MOTHER REPORT ON ME. WE HAVEN'T BEEN TOGETHER FOR 5 YEARS NOW BUT SHE STILL LIVES IN MY HOUSE SINCE I'VE BEEN TRYING TO KEEP MY KIDS CLOSE TO HER THE MORE THAT I CAN. THIS PERSON HAS MEDICAL CONDITIONS LIKE BIPOLARITY, ALCOHOLISM, SCHISOPHRENIA AND MORE. FOR YEARS I BEEN TRYING TO FIND HER HELP AND SHE NEVER WANTED TO GET REHABILITATED. WE'VE EXPERIENCED VIOLENCE FROM HER, I HAVE WITNESSES, VIDEOS, MESSAGES, PICTURES OF EVERYTHING THAT SHE HAS BROKEN IN THE HOUSE (GLASSES, CHAIRS, BATHROOM STUFF, ETC.). WELL, SINCE SHE MADE A REPORT AGAINST ME TEY ARRESTED ME AND I HAD TO PAY A BOND AND NOW I HAVE TO PROOF THAT IT'S HER THE ABUSER. I HAVE 2 CHILDREN WITH HER BUT I RAISED MY 3RD ONE THAT IS NOT MINE BUT IT'S BEEN WITH ME SINCE HE WAS MONTHS OLD. HOW DO I PREPARE MYSELF FOR THIS CASE AND HOW CAN I ADD HIM IN A PETITION TO GET THE CUSTODY OF MY 2 CHILDREN AND GUARDIANSHIP OF HIM IF IT'S POSSIBLE?
A: My FIRM advice is to hire a local attorney who practices both basic criminal defense as well a Family law. The issues are combined and the right work on the Family Law case will profoundly benefit your criminal matter. It is also a great wedge against her to force her to be more responsible. You will need a private lawyer and DO NOT try to DIY this, its super complicated.
