Q: How do I file a motion or application to get an ammendment of judgement under idaho code 19-2604.

At sentencing, my judge and prosecutor both agreed to allow me to have my charge ammended after I completed probation. I just need to know how to FILE for it. Or what form do I need to file, or how do I get a court date to make this happen. It's idaho code 19-2604. I just need the form/s to make this happen. Thank you

A: Here's one example you might use:

Comes now the Defendant, ________________, In Propria Persona, and hereby moves this Honorable Court to DISMISS the criminal charges against the Defendant, pursuant to Idaho Code 19-2604.

This motion is made and based on the Court and the State's attorney agreeing that if the Defendant finished his probation, and the Court found that at no time during his probation was the Defendant charged with or found guilty of violating his probation, that the Defendant may petition this Court for a dismissal of his charges.

The Defendant now stands before this Court to exclaim that during his probation, he has never violated, let alone been charged or convicted of violating his probation and in all respects has governed himself as a respectable, upright and law-abiding citizen, worthy of a second chance.

Wherefore,

The Defendant, humbly petitions this Honorable Court to grant him a DISMISSAL of his charges.
