Greenwood, AR asked in Animal / Dog Law for Arkansas

Q: ? the 4th and 14th amendment states dogs are personal property. if the state of Arkansas euthanizes your dog

The City of Greenwood AR cited me for a dog bite to a friend at my house, question is if the animal office enforcement euthanized my dog before the court date and does not give any notice they were doing so, is that a violation of my civil rights? according to title 5 -criminal offenses subchapter AR Code 5-62-125, 5-1-102, in 5-62-125 I have received no notices, and I also sent via email to the officer. A Notice of Administrative Hearing, stating I request a hearing and oppose any action in euthanizing, adopting, or relocating my dog; so, I may have a chance to get my husky back.

court date Feb 22-2023 if I'm hearing right, they already euthanized my dog.

A: If they have in fact prematurely euthanized your dog without properly following the required procedures (ie Due Process), they may very well be liable to you for the fair market value of your dog.
