Q: What if the alleged DV victim is actually the aggressor?

My husband and I were involved in an altercation. It started with him taking my cell phone from me. I followed him to get it back and told him I’d leave if he returned it. I reached for his hand and the result was me being repeatedly hit and shoved. All while I was only after my phone and keys. At one point he even choked me from behind, while I was teaching for the phone. Police were not called but he filed a report the day before I did and said I attacked him. A report was filed by the hospital on my behalf the following day. Neither of us wanted to press charges. Is it possible to prove based on my injuries that he was in fact the aggressor and not the victim?
