Q: How to fight DUI charges in Illinois when I was parked and not driving?
Received charges in May 2022. Was parked in the parking lot using the car for shelter. Had no intentions of driving.
A: In Illinois, you either have to be driving or “in actual physical control” that generally means able to drive.
