Q: Speeding ticket, 86 in a 70 in Carlton Co. MN. Clean record for over 10 years. Can I get a continuance for dismissal?

A: You're ultimately asking the wrong question here. The question is not can you get a CFD, but will you get a CFD. The biggest problem you face here is that you were allegedly driving 16 mph over the speed limit. The fact that you are outstate also makes a CFD less likely. You can certainly ask for a CFD or a stay of adjudication, but I think that it is unlikely unless there are some factual or legal issues with the traffic stop.

A: Why not? Either that, or put up the best defense at a trial. I would. What would you have to lose? (A reduced fine ain't going to cut it.) I think a reasonable prosecutor would agree to it, given a clean record.
