Q: Does the state have to provide proof of refusal to present the dog for chip inspection to be charged with 347.515

A: "The owner of a dangerous or potentially dangerous dog must have a microchip implanted in the dog for identification..." I admit, I am not sure what "proof of refusal to present the dog for chip inspection" means. You seem to feel an owner is not violating the law unless he openly refuses to comply with the law; and to go a step further, you feel the state must prove the he openly refused to comply with the law. You can certainly make this argument, but I don’t think a judge will buy it.
