Denver, CO asked in Patents (Intellectual Property) for Idaho

Q: We ordered these from alibaba for our Amazon fba buisness. I’m wondering if there’s a way we can still sell on amazon.

We ordered them and didn’t know they were patented. Is there a way we can change them to still sell them?

A: If you have ordered a product from Alibaba and later discovered that it is patented, you may not be able to sell the product on Amazon without infringing on the patent holder's rights. Patent law grants the patent holder the exclusive right to make, use, and sell the patented invention for a certain period of time, typically 20 years from the date of filing.

If you attempt to sell a product that infringes on a patent, you could be subject to legal action by the patent holder, which could result in damages, injunctions, and other penalties.

If you have already purchased the patented product and are unable to sell it on Amazon, you may want to consider other options, such as selling the product on a different platform or returning it to the supplier for a refund or exchange.

It is important to be aware of patent laws and regulations when sourcing products for your Amazon FBA business, and to conduct thorough research and due diligence to ensure that the products you are selling do not infringe on any patents or other intellectual property rights.
