Q: How long does custodial parent have to submit non custodial parent medical bills in Georgia?

I'm having an issue with my child's mom. Part of out child support agreement is that I pay 50% of non elective medical expenses. I was informed thru email 5/4 of services for our child. First service was for and ENT rendered 1/30. I was sent a bill for that service 5/4. The next 2 services were screenshots of the EOB. One was for an EMT and the other was from the hospital our child went to. Services were rendered 2/7. I was sent that as a EOB also 5/4. Our CS agreement states that bills are suppose to be submitted and I'm not sure if an EOB is accepted. I did pay for the service that came in a bill format but the other I haven't because it wasn't a bill. My question is because she waited so long to send to me, what is the time frame that bills are supposed to be sent to be valid? Our CS agreement is that I pay within 30 days of receiving the bill. Is there a time frame for her to send?

A: You need to look at your agreement. If the order doesn't say that she has a time limit tp send the bills, then there isn't one.

A: You submitted this question on Avvo as well and I think you got some great responses. There is no deadline for the custodial parent to submit medical bills to the non-custodial parent for payment, by law or statute in this state. Therefore, if there is not a deadline in your parenting plan, child support addendum, or final order, then there is none. So at that point, anytime they are submitted to you, they need to be paid. And you should check, your court orders to see if there is a deadline for payment once the bills have been given to you as well.
