Q: Will my ex husband have charges and go to jail?
He was in a serious car accident Memorial Day. Been in hospital and now pt rehab since. He left me a drunk vm that day but I don’t know if there were charges. Would be his 6th dui. No driver license since Feb 2003. Bench warrant for outstanding child support. Obviously no insurance or ID. Rolled car, broke through a telephone pole and was ejected. Would the police automatically take a blood alcohol level? What charges might he have? I want to prepare my kids. He’s getting out of Mary Freebed rehab this weekend. I have full legal and physical custody. He has 1-3 hours supervised visits/week. He is toxic for my kids and I am hoping he’s held accountable this time. Will police know he’s free and will they charge him with a crime?

Very likely he will face charges related to this. Typically in this situation like this, the police would have a blood draw and will charge him based on those results when they come back. And obviously it will be easy to confirm driving without a license, which is a misdemeanor itself.
The police are likely already a step-ahead of you and will lodge him in jail when he's released from the hospital. He'll have a bond. But if this is in fact his 6th DUI, he's likely facing some time.
