Q: Trying to see if its possible for a judge to take my daughter from me..

A: It's possible if the judge feels your client could be in danger. You may want to reconsider if the relationship is worth the possibility of losing custody of your child.

A: You should hire an attorney ASAP. If a motion or petition has been filed by the father for a change of custody, you should act fast. Because if there is an emergency hearing and the court grants the father temporary custody, that temporary period where the father has the child will benefit him when it's time for the court to make a final determination on physical custody. And yes, if your fiancé was living with you at the time, the arrest for possession can be brought up in court as a reason why your home environment is unfit for your minor child. It could also call into question your sobriety. I would take this matter very seriously because if you do lose custody, it is going to be very hard to get it back.
