Q: Will is with probate Judge (I think) How do I know for sure ? My sister is executor and says will with judge . Ok.. so
In the will a sister is willed the contents of our Moms house . 4sibs. 3sibs split the sale of house .
Will still with judge.
Sister who gets contents is time sensitive as to when she can come collect "her inheritance,." She has to go back to work. And she won't be as available to come get contents as she is now..
So lawyer tells executor it is ok for sister to come get contents he has given his permission altho he is troubled that my Mom may owe Debt and executor said she told him she doesn't owe Debt . Ain't seems like he is making a huge decision..amd trusting that no debt is owed ...hmmmm.Will is not released yet. So why is there even a process of going thru probate and judge if our lawyer can just overide the process .. is he allowed to do that ? Overide the process? And give his permission for sister getting contents to get the?
A: If the Will is filed for Probate then it is in the Court's file, so check with the Court. If there are sufficient assets involved, you will want to hire an attorney to represent you. Also go to any Court hearings, and ask the Clerk when they are.
