Q: We live in Georgia, child lives in Florida. How do I petition for custody as an extended family member with consent?
Mother has completed Waiver of Consent form, currently not able to support child. Recent erratic behavior of mother has prompted family to intervene. The 'father' has not been present since birth, his paternity/location not known.
Can the petition be filed in Georgia?
Is an attorney required being that the mother has consented? What is the cost of limited appearance of an attorney if requested? Is it necessary to complete the Affidavit of Diligent Search if the location/paternity of the father is unknown? What is considered approved documentation of searches? The birth certificate is being updated as the person listed has been confirmed not to be the father. How does that affect filing the petition? Can we move forward? Are there any fees, paperwork, etc. that may result after the process has begun pending these changes? And other questions/items you may think that we have overlooked.
