Q: What happens if you are still going to court over lawsuit and the statute of limitations has expired in illinios?
I dont remember much of my accident but i was stopped and looked both ways before turn left now i being sued i did not receive accident report i suffer from ptsd and short term memory loss its been two and half years
A: Illinois has a 2 year statute of limitations for motor vehicle accidents, without taking exceptions into account. So long as the civil suit was filed on or before the 2 year anniversary of the accident, the case will remain in court until it comes to a resolution. A resolution to the civil case could take years.
