A: The Criminal Offenders Employment Act in New Mexico (often referred to as the Criminal Offenders Act or COA) typically pertains to convictions rather than charges. The COA generally addresses the employment of individuals who have been convicted of certain offenses and may restrict their eligibility for specific types of employment, particularly in state government positions. If you have not been convicted and are only facing charges, the COA may not apply to your situation in the same way it would to someone who has been convicted of a relevant offense. Additionally, if you are not a probationary employee, you may have certain rights and protections under employment laws in New Mexico.
