Clermont, FL asked in Business Law for Florida

Q: Can a contract be voided if it was signed under a false premise due to an egregious error by a plumbing company.

I had a water leak in my home; water leaked through the floors, and out the front door.I had a plumbing company come out to assess the leak. They said I had a leak from underneath the concrete slab, and they would have to cut through the wall and jackhammer through the floor to get to the pipe to fix it.The water restoration side of the same company came out the same day and presented a contract to sign on their ipad, listing the things they would have to do to restore my home.I got another plumber to come out and assess.Turns out it was only a leak from the icemaker water line. This plumber shut off the valve, and turned on the water heater, and water valves which the original plumber had turned off.All of the leaking stopped. The restoration company has been talking to my insurance company, and want to continue as though their wrong assessment doesn't matter, but I told them their contract was null and void since the things listed on the contract included things they no longer had to do

A: Yes, assuming the contract has not yet been performed, notify them, in writing, that you no longer need them to do the work.
