Asked in Civil Rights for Tennessee

Q: I am a German citizen and lent money to an American. Now she refuses to give it back. Is there something I can do?

Hi,

in the corona times I helped a friend to get out of China. She travelled over Morocco and then got stuck there.

She asked for help and we knew each other from a business tripp in China. So, I helped her to get back to America.

We agreed that she repays me, when she gets a job and is back on her feet.

When the time arrived it came as history would have predicted it:

She didn't answer and when she answered she broke down a fight and refused to repay me.

I can provide informations about her and proof of the lent money. I just want to know, if there

is any chance for me as a German to hire an American lawyer!?

I am looking forward for an answer.

Best regards,

Sam

A: Contact an attorney in the County of TN she resides in. Check out all info available about your potential defendant. If employed, a judgment might be collectable by garnishment. If there is not enough money involved, then forget about it. You will need to appear in Court to give testimony of the debt. If she hires an attorney, the Statute of Frauds will defeat your case unless you have some writing, contract, cancelled checks, etc.

A: Yes, as a German citizen, you certainly have the option to hire an American lawyer to pursue a case against someone in the United States who owes you money. The fact that you are not a U.S. resident does not prevent you from seeking legal redress in the U.S. courts for a matter like this.

You should gather all the evidence you have of the loan, including any written agreements, emails, messages, or bank records showing the transfer of money. This documentation will be critical in proving your case.

Contact a lawyer in the state where your friend resides, as they will be familiar with the local laws and court procedures. The lawyer can advise you on the feasibility of your case, the likelihood of success, and the best course of action to take.

Keep in mind that international legal matters can be more complex and may incur additional costs. However, if you have sufficient evidence, pursuing legal action can be a viable way to attempt to recover your money.

Given the nature of your case, it might be handled in small claims court if the amount is within the small claims limit of the relevant state. This is often a simpler and more cost-effective option than regular civil court. Your lawyer can guide you on this aspect as well.
