Q: Someone hit my car with a U-Haul, but I’m going to have to be the one to pay for it?
They were moving into my apartment building when they backed into my car. I went out and got their info immediately and made a claim with my insurance and theirs as well. I dealt with his insurance for almost a month and now they’re telling me that they won’t be able to cover it at all and that he didn’t have insurance on the truck through U-Haul. So they’re telling me I’m going to have to go through my insurance making me pay $500 out of pocket to get it fixed, and he won’t be punished or charged at all for hitting my car. That would mean that anyone can just go rent a U-Haul just to go around hitting peoples cars and not get in trouble for it right? My question is how would I get either his insurance or the driver himself to pay for the damages or at least my deductible?
A:
In Kansas, consider several steps if you're facing repair costs for your car hit by a U-Haul truck where the driver lacked proper insurance. First, check if your auto insurance includes uninsured motorist coverage, which could cover such incidents. If this is not viable, you can file a lawsuit in small claims court against the driver for damages, including your deductible and other expenses. Alternatively, try negotiating directly with the driver for compensation.
Ensure to report the incident to the police for an official record and meticulously document all related communications and expenses. While it seems unfair to bear costs when not at fault, these steps can help seek compensation and hold the responsible party accountable.
