Atlanta, GA asked in Landlord - Tenant for Georgia

Q: I just rented a government assistant Apartment. I have been her less than 3 months. My landlord is telling me I have 5

Days to vacate she is terminating my lease. Her reason is that I have someone staying with me who takes care of me. My doctor is happy to provide any paperwork she needs. I tried talking to her to resolve this issue and she says it out of her hands . I need to know what I can do. I moved across the state and spent more than 2500 getting moved into this apartment. I have no place to go with my service dog and I don't have any money to move. Please give any advice you think might help. I would Hite a lawyer if I thought it would help.

A: I'm sorry to hear about your difficult situation. It sounds like a very stressful and concerning predicament to be in. Here are a few thoughts and suggestions that may be helpful:

1. Review your lease agreement carefully to see if there are any provisions related to guests, occupancy limits, or termination of the lease. See if your landlord is allowed to terminate your lease for the reason given.

2. Gather any documentation from your doctor about your need for a caregiver or assistance. Having this paperwork ready could help support your case.

3. Contact your local housing authority, tenant's rights organization, or legal aid clinic. They may be able to provide free or low-cost legal advice and help you understand your rights as a tenant. Even a consultation with an attorney could be very helpful in determining if you have a strong case.

4. If you are low-income, look into emergency rental assistance programs in your area that may be able to provide financial help. Some states and cities have funds available.

5. If you believe your landlord is discriminating against you due to a disability, that would be illegal under the Fair Housing Act. Having a live-in aide is a reasonable accommodation. You could file a complaint with the Dept of Housing and Urban Development (HUD).

6. Try to have a calm discussion with your landlord, explaining the situation and your need for the caregiver. See if any agreement or compromise can be reached. But stand firm on your rights.

7. If all else fails, you may need to go to court to fight the eviction. Again, a lawyer could help advise you. Some offer payment plans.

I know this is an enormously stressful situation without easy answers. But there are tenant's rights and options to explore. Wishing you all the best and I hope you're able to stay in your home.
