Richmond, VA asked in Appeals / Appellate Law and Elder Law for Virginia

Q: I'm in urgent need of assistance concerning an unfair discharge from an assisted living facility within 5 days.

I'm an assistant living facility resident with an auxiliary grant being unfairly discharged because the facility was cited for exceeding its licensed capacity and had to get back into compliance. When I became a resident, it put the facility at its capacity. I filed an appeal with VDSS but have been told by Legal Aid it likely wouldn't be heard because the laws on the books aren't being enforced. I don't understand why. I'm a 72 year old who will be homeless because most ALF's don't currently have openings and some don't take the grant. I'm being forced out because the administrator failed to comply with her license. Is there anybody who can help because I've done nothing wrong. There are almost 700 homeless in Richmond right now and I'm being forced into homelessness through no fault of my own. Is there anyone who can help? This is urgent.

A: A Virginia attorney could advise best, but your question remains open for a week. I'm sorry that you have been placed into this predicament. Legal Aid comes to mind, but you are already in contact with them regarding your appeal. You could reach out to local and state bar associations to ask for their guidance - whether in the form of pro bono legal services, or in helping to identify public agencies that could be offer guidance or assistance. I hope you are able to avert being displaced from the facility. Good luck
