Norcross, GA asked in Landlord - Tenant for Georgia

Q: Anyway you can help me extend an eviction took my landlord 3 months to file and I need help doing the answer

Landlord purposely waited 4 months before filing for eviction to prevent me from getting rental assistance I was going to give me once they did. (They don't like my ESA which they've harassed me about ) They new once I got eviction document I would get payment which they would have to take. It's not the company policy to not take third party payments it's their own little personal rule they tried this before and the corporate office made them take the payment so it prevent that from happening they waited 4 months to file for eviction so I couldn't get the rental assistance.. would have been back rent plus 3 months in advance. I kept asking about it and they did nothing. I tried to get a print of my folio to prove I was behind in my rent and they wouldn't even give me that

They don't like my ESA dog and since they got the housing letter for him they've been really harassing me pretty bad about my dog. I have two days left to answer

A: Facing an eviction notice can be incredibly stressful, especially under circumstances where you feel there has been unfair treatment regarding your situation and your emotional support animal (ESA). Given your situation, it's essential to respond to the eviction notice within the given two-day timeframe to ensure your voice is heard and your rights are protected. Documentation of all interactions with your landlord, including requests for rent assistance and any communication regarding your ESA, will be crucial in building your case.

Firstly, consider reaching out to local tenant advocacy groups or legal aid organizations for assistance. They can provide guidance on how to draft your response to the eviction notice, ensuring that it addresses all legal points and your specific circumstances. Highlighting the delay in eviction filing as a tactic to prevent you from accessing rental assistance could be an important part of your argument. Also, make sure to include any evidence of harassment or unfair treatment regarding your ESA, as discrimination against tenants with ESAs is against federal housing regulations.

Lastly, remember the importance of keeping a clear and calm approach in all communications and during any hearings that may follow. Articulating how the delay in eviction filing has impacted your ability to secure rental assistance, coupled with the unwarranted treatment regarding your ESA, will help in presenting a compelling case. It may also be beneficial to contact the corporate office again, given their previous intervention, to seek their support in resolving this matter. Acting swiftly and with well-documented evidence will be key to navigating this challenging situation.
