Q: What can I do to get my child a passport if the mother is refusing to sign the required documentation?

A: It depends on what the custody order says. Who has legal custody? If you have legal custody, you may be able to complete the application without the other parent's participation. Depending on what your court order says, you may also likely be able to file a motion to compel the other party to cooperate with the passport to exercise the parenting time on a vacation. If the order restricts international travel or there is a safety concern, the Court may deny the request. I've had this issue come up a number of times. Often the Court allows the child to travel internationally with a parent, including requiring the parties to cooperate with the passport, visa, etc. However, it depends on the specific facts of your case. You would want to consult with an attorney about what you may need to file to ask for the Court to compel the other party to cooperate.
