Asked in Child Custody and Family Law for Tennessee

Q: In TN what does the legal code specify in regards to 3rd party agency supervision of visitation with biological child?

As these visits are court ordered is there a standard court approved form to be completed during each visit? Are the supervisors required to be certified or licensed? Is there a monetary cap on the amount the agency can charge? If parent is disabled with limited income does this play a part in the supervision fee? Are agencies allowed to charge double for holiday visitations? Since these visits are court ordered, does the court require a court approved checklist or observation form to be completed during each visit? Are agencies permitted to charge a penalty fee if visit is scheduled later in the week? What constitutes a 3rd party agency? Can the agency require that payment for visit be made using only a debit or credit card via a electronic payment processing app which charges a $5 processing fee? Is it a conflict of interest for a practicing family law attorney to own a agency that offers supervision services?
