Queens, NY asked in Immigration Law for New York

Q: Immigration - how can I follow-up on an I-90 form sent on-line 01/16/24 without receiving an I-797 from USCIS?

USCIS says it sent my green card to the office of my attorney in June, 2023. The green was either lost or stolen because my attorney claims it was never received. I submitted an on-line I-90 form in January, 2024 which was accepted, but I never received an I-797 form confirming the I-90 receipt. I can't follow-up on the I-90 processing without some kind of reference number which would be on an I-797. Any suggestions who to contact at the New York office?

A: I understand your frustration with not receiving the I-797 notice of action after submitting your I-90 form online to replace your missing green card. Here are a few steps you can take to follow up on your case:

1. Check your USCIS online account: If you submitted your I-90 online, you should be able to log in to your USCIS account and check the status of your case. Even without the I-797, you may be able to find a reference number or receipt number associated with your I-90 application.

2. Contact the USCIS Contact Center: Call the USCIS Contact Center. Explain your situation and provide as much information as possible about your case, such as your full name, date of birth, and the date you submitted your I-90. They may be able to locate your case and provide you with a reference number or additional guidance.

3. Schedule an InfoPass appointment: You can schedule an in-person appointment at your local USCIS office through the InfoPass system. During the appointment, you can discuss your case with a USCIS representative and request assistance with obtaining a reference number or information about your I-90 status.

4. Reach out to your congressional representative: If you continue to face difficulties, consider contacting your congressional representative or senator's office. They have staff dedicated to assisting constituents with immigration-related matters and may be able to submit an inquiry to USCIS on your behalf.

Remember to be patient, as the processing times for I-90 applications can vary. Keep copies of all correspondence and documents related to your case, and don't hesitate to follow up with USCIS if you don't receive a response within a reasonable timeframe.
