Seymour, IN asked in Estate Planning, Family Law and Elder Law for Indiana

Q: Parents recently passed away, now step brother accusing me of stealing everything does he have a case to take to court?

Father in declining health, step mother diagnosed with dementia. They made arrangements to move to assisted living but before that could happen she declined rapidly and had to be put in a memory care facility. My father went ahead and moved as he could not stay alone. He went through the process to have her put on Medicaid, which meant they had to separate her from house and car title(only property they owned) and bank account. My father used his POA to accomplish these things and opened a separate checking account with me(rights of survivorship). He paid all his own bills and his portion of the memory care facility from this account. He passed in Dec 2023 and she passed Jan 4 2024. My step brother is now saying I stole everything and he is owed money-says he will take me to court. There is no will-there was no property as he had sold his trailer and car when he moved to assisted living. Does my step brother have a case-also says he is calling Medicaid & filing a fraud case
