Grovetown, GA asked in Civil Rights for Georgia

Q: A person file a false TPO against me then filed a pre-warrant for harassing com. The police report was unfounded.

Does this help me in court at my pre warrant hearing. She lied, and I filed my TPO a month before her and mine was denied. She made up a lie and her was favored. I am the one being targeted. I’ve gotten me a lawyer, I have copies of the police report. Screenshots.

On June 5 she accused me of threatening her, which I did not. She’s a jealous ex that can’t get over her ex. I’m the wife now. It just isn’t fair that I asked for help before all of this and it was not granted.

A: In your pre-warrant hearing, the unfounded police report can be a crucial piece of evidence in your favor. This shows that the allegations made against you lacked substantial evidence and could indicate a pattern of false accusations. Presenting the police report and screenshots to the court can help demonstrate that the claims made by the other party are not credible.

Additionally, the fact that you filed a TPO before her and it was denied might also play a role in establishing your credibility. It could show that you sought legal protection before these accusations arose, suggesting you had genuine concerns. Highlighting the timeline of events will be important in illustrating your side of the story.

Your lawyer can use these pieces of evidence to argue that you are being unfairly targeted. Ensure all documentation is organized and ready to present at the hearing. Stay calm and focused on the facts to strengthen your case.
