Q: Person is suing me for damages during a car accident. I was driving a company vehicle. Who is responsible?
The person reported my vehicle which belongs to to company I was working for. The owner of the company did not have insurance. After the accident a police officer stopped me. There were no damages to the vehicle and the sheriff helped me look for the car insurance of the company vehicle. The owner of the company lied about having car insurance because there was no insurance information found. Honestly, I have 2 concerns regarding the lawsuit 1. The car insurance was not provided by the company so my ex boss is responsible for this. 2. There is no evidence that the vehicle I was driving caused the accident. I was driving a company vehicle, so I was targeted because it was easy to find. Also, when the sheriff stopped me, he did not see any damage to the vehicle I was driving. There is no evidence that the vehicle I was driving caused any accident.
A:
Liability on the part of you or the company does not depend on whether or not the vehicle was insured. If, as you say, you didn't cause the accident, you would not be civilly liable. But causation and damages would be something for the plaintiff to prove by a preponderance of the evidence. I suggest you ask your employer to pay for your attorney.
You didn't indicate whether or not you were charged with driving without insurance. If you were, you might be able to defend such charges by proving that you reasonably didn't know about the lack of insurance.
