Q: Orange County, Florida. Just learned main water line coming from meter runs under neighbor's property to my home. HELP!
Lines were there for over 20+ years unknown to me (possibly to him) when our houses were bought. Neighbor suddenly "discovered" a leak on his property next to but not under pavers and DIY turned off my water supply at the meter. Don't know if neighbor actually CAUSED the leak or how leak occurred. Says he dug up ground to "find" leak and traced it to my meter, but... he could have hit line and caused the leak. He wants me to pay to repair the leak. Don't know yet if there is any recorded easement but will check. All lots in neighborhood were part of one parcel looong time ago. I don't want to alter/lose any easement/use rights I might have by repairing the leak if I decide to do that and also don't want to be forced to relocate whole water line. Several houses BETWEEN me and the neighbor's house. Why the line is where it is we have no idea. Private road shared by all was moved ~150ft east sometime in way past BEFORE either of us bought our houses. We didn't know anything till now.
A: It looks like you have a prescriptive easement. At any rate, you would not be waiving any rights were you to decide to repair the water line.
