Q: Could AR code 16-93-618 subsection c apply to my 24 yr old son who was 16 when arrested for first degree murder?
He was an accomplice and took a plea of 25 yrs....which is 17.5 years on the 70%. He's served 8 years so far and I'm wondering if he might qualify to have the 70% lowered. If I read it correctly the sentencing judge at his discretion could waive subsection a of this section under 3 circumstances. All three circumstances apply to my son.. Juvenile, Accomplice, and Offence occurred in 2016.
I am asking for clarity for whether he qualifies to possibly have his sentence lowered from the judge and if so, what kind of attorney would I need to see for help with the situation? Any input you can give would be greatly appreciated. Thank you in advance!
